Help Getting ready To Sue!

    A couple questions, I have two collection agencies that I am preparing to sue. Just sent them the last letter "ITS" if I do not hear from them it is on!

    One of the collection agencies, replied to my demand for validation with a letter telling me they no longer have the account and they reported this to credit Bureaus but it is still on my report.

    The second never replied to any of my letters but yet a couple days ago they verified the debt with the CRA.


    Questions;

    1- Should I asked the CRA how they verified the account to make sure they did indeed verified with the collection agency?

    2- The CA is trying to collect several accounts from the hospital "6 or 7" When I go to sue them should I do it one account at a time?

    3- Do I file a separate law suit against the hospital for allowing the CA to violate my rights to collect their debt? or do I include them as defendants on the same lawsuit along with the CA?

    4- Should I do Federal or simply local court? I am aware that if I want to go Federal I will need a attorney".

    5- The one CA that has 7 accounts should I send a validation letter for each account or will a general validation letter suffice and cover all the accounts they have listed on my credit report?

    Yes - write for a procedures request.

    Purely a personal choice.

    Unless you have some state laws you are relying on, IMHO this may be weak.

    Now I'm confused. Have you sent validation before or not.

      Since jlynn was faster, I'll just add up to #1 ...
    • FCRA &sect;611(a)(7) obligates the CRA to give you a "[color=0066FF]description of the procedure used to determine the accuracy and completeness of the information[/color]". You may use a letter like the "Procedure Request".

    Yest I sent one validation to one of the collection agencyes, however they have about 6 or 7 hospital bills listed.

    On the seccond collection agency I sent a validation leter for each one of the items they had on my credit bureau. Shoul dI do the same on the first collection agency or will one validation cover all the items they have listed?

    I would do one for each CYA = Cover Your A$$

    I'm also a cheapskate. Others may cringe, but I have been known to send disputes to the CRAs for both DH and myself at the same time. One brown envelope with multiple letters = $4.42 once instead of twice :) just reference the Certified Mail Tracking Number on each of your letters.
