Put 2 Providian cards in the program. Payments made automatically everymonth to CCCS company and they disbursed every month to Providian on time as per new payment agreement, APR, etc. Find out in Feb of 2004 (buying a car this summer) that Providian has inexplicably reported me delinquent every month since June on one card and scattered 2-3 30 days late on the other. They claim CCCS never called to reage accounts. CCCS claims they never received notice that it had to be personally done. CCCS assumed customary reaging after 3 consecutive on-time payments. Providian, at one point in discussions with CCCS, agreed to reverse entries as per agreement with CCCS. Providian now says they wont do it. No reason given. My course of action: February 2004, I disputed with CRAs initially when I learned of the inaccuracies. Came back verified. I then let the CCCS try and take a stab at it. After a month and half, got call from CCCS saying Providian agreed to remove entries. But Providian has changed tune. May 2004, I dispute by Fax and Priority Mail/Signature Confirmation directly with Providian. I then immediately dispute with CRAs once again. Possible Violations: Just checked my PG report and Providian has submitted monthly reporting data for the month of May to CRAs, but failed to note that the account is in dispute. Also, since they have known they are reporting misleading information since February, are they not in violation of Section 623 of FCRA? CSRs clearly confirm that they have indeed received every payment on time, but they claim reaging never took place and should have been called in. Would this stand in court? Finally, if they received my dispute on May 5, how long before I have to hear back from them based on FCRA or FCBA guidelines. I believe it's 30 days, but I've heard 60 days based on FCBA guidelines. reage, as CCCS and Providian refer to it, means to bring the account current and "paying as agreed." This was supposed to take place back in July 2002. I never realized they were reporting me late because once I signed up with CCCS, I had no plans to apply for new credit for a while. Also, every month the CCCS co. would pull funds from my account, i would receive a statement from CCCS and I figured, all is well. Not so apparently.
don't trust ANYTHING about Providian - pardon my jumping in - I'm a newbie, but the very sight of the name of that company raises my BP - on my hubbys cr, they continued to list a settled debt, as a charge off at the full balance, for the past year and a half, and, assigned the amount negotiated out in the settlement to another CA, a month after the settlement - and they were reporting it as a collection acct -so instead of showing a settled acct with no balance, they were showing what appeared to be two sep accts (they used two acct numbers) with CO & collec accts in excess of $8k - I have been hounding them for a month, by fax, mail, certif mail, to everyone from cust service to their in house legal dept to the board of directors - thanks for the opportunity to vent - I have enjoyed getting to know this site - just found it this evening -
