I live Ca. This is over a car repo that happened in late last year after only 6 payments. Stupid. But now I have to deal with them. Up until now I was ignoring them hoping they would not threaten to sue and they did. I need help with drafting a response. Please. I have under 10 days to do so. What do i do? I was served, have the summons in hand. and DO NOT WANT THIS TO GO INTO A DEFAULT JUDGEMENT.
Let's be honest here. It's not going to be hard for them to prove that you owe the debt. It's too new, since you made payments for 6 months. When did you default on it? In the 7th month? Did they wait 30 days or longer before repoing it? Did you receive a notice stating that you had the option of paying all past due fees and payments to reclaim your car and continue with the contract within 10 days after the repo? Did they give you a notice of the date and time the car was to be sold and by whom? Did they give you notice of how much the car sold for? Were you present at the auction. Did you get into a fight with the repo guys in the parking lot and got hit on the head when they were trying to take it? You left ALOT of unanswered questions.

I was temporarily living 400 miles from my permanent residence when all of this took place. I had put the car up for sale and have a copy of the ad, but that would not matter. I did not intent to keep the car after all, situations changed for me financiallyâ?¦ I ran out of time and GMAC took the car. Re: Re: Help: I have been sued by G If you were 60 days late, that puts the account at 9 months. They will have ample documentation to prove their case. I suggest you find out exactly what the car sold for, what their fees are and what offer their willing to make with you. I would STILL show up in court, that's a must regardless. You don't want a default judgement without appearance. I would make them an offer to settle it.
