We had to file chapter 7 last year. I wish I would have found this site before as we need lot's of advice and help.
My husband is very ill and we had to move to Idaho after my mother died so that I could start a new job. We had been with Cambridge that help's with all our credit cards to arrange payments that would be lowered along with the interest rates and paid faithfully for 18 months prior to our move and then my mom died and John had to quit working so we had to stop our payments but after six months got right back on the plan. We were living on a very small amount of money and was paying 681.00 dollars a month and did that for almost year. It was such a struggle but we wanted to pay back what we owed. After speaking to the CEO of the company I work for he advised filing. We hated to but we just couldnt go on living after paying rent and that bill on about three hundred dollars a month
Recently my husband decided to run a credit report on me and found that there were 38 negative remarks on me and the problem is I never had all these credit cards and some of them were his and never in my name. I was the main caretaker for my mother and she had cards that allowed me to use them as it became harder for her to get around. They were used for her personal expenses used to help pay bills . I paid all her bills and seen to all her needs. These cards were not taken out in my name. These never were shown on my credit report before and now that we filed the bankruptcy all of her cards have shown up on my credit report. I think the last time her bills were paid was in 2003 towards the end of the year. I know some of the things on my credit report can be corrected (I hope!) but its these bills I am concerned with. My name never appeared on the billing. The problem is John is very ill and I am concerned about this affecting his mental state and it is messing with my mind. I am concerned about the future and being able to rent a place after he is gone should I decide to move closer to family I worry that I wont be able to find work. I am really desperate to try and get this fixed. I am scared to argue with my mothers creditors afraid that they will come after me and I couldnt handle it. My plate is full and I am trying to hold down this job which is very stressful and take care of him and our home. Tell me where do we start should I open the can of worms or just try and fix the ones we can. Any advice would be so wellcome. We will look forward to hearing from you. Worried in Idaho.

Look at your credit report (straight from the credit bureau), and tell us what it says under "Responsibility". It is likely that you were only an Authorized User, and were never financially responsible. If that is the status, and they are negatives now, they are usually very easy to dispute off your reports.

Even though your mom never made you a "joint" cardholder, she must have made you authorized user for you to be able to use the card. Did you ever get a card with the same account # in your name?

Have you closed your mother's accounts? When she died, who handled the estate? A notice should have been put in the paper and if creditors didn't respond, too bad for them. If there is no money in her estate, there is no liability.

If she left an estate, the bills would have to be paid from it before anything was distributed.

You need to cancel those accounts that were your mother's. Tell them that she is deceased and left no estate. Send a copy of the death certificate.

After they're closed, just dispute them on your reports saying it's not your account.

42 is a reference from Hitchhiker's Guide to the Galaxy. 42 is the answer to life, the universe, and everything.

And tell your husband not to stress. He has enough to worry about. We'll help you with this!

When you get a letter from the CA stating how can it be settled, just reply and tell them there is no estate, and no money to settle with. You have no liability for the debts if you weren't a joint account holder.

If it's only in her name, it shouldn't be a problem.

Go back to your reports and dispute everything that is not yours by typing in "not mine".

Cancel the accounts before you dispute anything. Right now, if you dispute as "not mine," the account will be verified because you are in fact listed as an authorized user.

After the accounts are closed, you can dispute them, not as "not mine," but as "I am not authorized to use this account."
