O.K. I have 2 quick things ? 1st thing- Received a letter from NCO stating that they are contacting the original creditor blah, blah, blah and that they will let me know something. Should I ask them to deleted while we wait, or what ? 2nd thing- I called to pay to collections today, 1 from Peirce Hamilton and LJ Ross I think between the both of them they total $350.00 and the guy at PHC told me that they would not delete in exchage for payment, they would just update to show $0 balance, should I take this and go, he said that according to the FCRA they are not allowed to DELETE for payment. I was thinking that by just paying them I would be washing my hands of the debts completely. I am starting to get frustrated !
1st thing - after 30 days, send C&D (estoppel) and tell them they have not validated, they must delete. 2nd thing - how old are these debts? paying usually does not get rid of them, and for that little bit of money, I doubt they will delete, but I would keep trying.
That is a whole bunch of crapola! They can delete for payment. I was just recently dealing with PHS. I did not need to pay them because I did not owe anything. My acount has been updated to show PAID on EFX previously.They claim they did not ask EFX to update it. But I was able to get deletion from them . I just checked my CR today, and it's already gone.
PHC is playing hardball. Nothing in the FCRA states that they must report. Only that if they do, it must be accurate, and negatives can't be reported beyond the 7 years. It's their call to report a $0 balance or delete it altogether.
The debts are not due to fall off until 2006, that's why I was thinking to pay them and have them removed.
