hello someone please help , money was taken from my bank acct without me being told by old credit card debit from 6 yrs ago ..what can I do , my rent will bounce and all my bills .. I tried calling to find out who and how they did this to no avail.. can I do anything to get my money back .. please help in what I should do . I tried calling the courts and the lawyer who took my money but he has no human answering the phone or answering machine . I really don't know who took money out of my checking ... neither does the bank all they told me was the lawyers name .. can a creditor from 6yrs ago do this ? THANK YOU
Are you sure that you have no knowledge of the creditor contacting you? Apparently the creditor got a default judgment against you and that is how they were able to seize your bank account. The same thing happened to me a couple of years ago but I lucked out. I informed the CA that I lost my job and I sent it CRRR AND they seize the account for a credit card I was still disputing with them. So since I already had a payment plan set up with them, I told them to credit that plan with the seized amount and they left me alone. You should have gotten some type of legal documents in the mail letting you know this was going to happen. Check with your county clerk's office to see if they are any default judgments against you. Also check to see if the SOL expired on the account. In my state (NY) it is six years, some states are more than that, some less. Good luck!
