hello someone please help , money was taken from my bank acct without me being told by old credit card debit from 6 yrs ago ..what can i do , my rent will bounce and all my bills .. i tried calling to find out who and how they did this to no avail.. can i do anything to get my money back .. please help in what i should do . i tried calling the courts and the lawyer who took my money but he has no human answering the phone or answering machine ..
What does your bank say? Do you have a judgement against you, and were they presented with a court order?
NO , MY BANK GAVE ME VERY LITTLE INFO THEY SAID THEY DID NOT KNOW MUCH EXCEPT THE LAWYERS NAME .. 6YRS AGO WHEN MY CREDIT WENT BAD I HAD A JUDGEMENT .
They would have to have been presented with some court document to garnish your account. They can't just get a call "give me this much out of this account number", and do it without a court document. Get a copy of it. Although they may have paid the lawyer based on that judgement, without the garnishment order, how do you know? And if there is any error, as to whether you were the correct party, or the amount, you better deal with it now. In addition, if you have paid that amount of money toward the judgement, you don't want some other party later coming after you for the same judgement.
thank you but i don't know much of what or who they are that took the money but the bank said they mailed me the info on the 26th still nothing in mail... also this money they took is from a judgments from 6yrs ago and the money they took included my child support deposit and thats not right that with out warning or knowing what my money is needed for or from whom the money came from they take it .. any thoughts please.. it seems that having hard financial times gets us a worst prison term then criminals and we all at times going thru hard times with our moneys sad part is none of my credit debits were over $500 all is from legal fee they add on ..
If possible, go to the bank and demand copies of the garnishment order. Do you have copies of the original judgement? It's possible that you may fall into a particular category within your state law that makes you judgement proof. Get the papers and talk to a lawyer. If it's legitimate, it's very possible this could be negotiated down.
