Although I have no desire to weigh in with an opinion about bank employees, or even about Fred15, I will address the Terms of Service question. No, Fred15 did not violate the Terms of Service, and neither does his posting represent a personal attack. Personal attacks are those comments which single out a specific person. On the other hand, comments which disparage companies or categories of employment are par for the course here. A common example: "Bill collectors are morons." (Exception: "hate speech" against protected minorities, i.e., comments which criticize others based upon race, religion, ethnicity, gender, and sexual orientation, will not be tolerated. Unfortunately, bank employees are not legally protected minorities [reference link]). In other words: Not a personal attack: "Car salesmen are morons" (even though we probably have car salesmen among us -- who are perfectly capable of defending themselves). A personal attack: "JosephB23, you are a moron for being a car salesman" (which singles out JosephB23 in violation of the harassment provisions of the Creditnet Terms of Service). With that, I hope this thread will be returned to its perfectly acceptible topic: whether or not there seems to be an increasing proliferation of incompetence within our banking institutions. Bankers are welcome to defend themselves and, perhaps, even allege increasing incompetence among bank customers as well. CCN steve

(1) Eric 2002 accused someone of being "arrogant" while bragging about how much money he made, which was totally irrelevant to the question. His response was arrogant by definition. I hope that no one will be intimidated by his blatant, ridiculous hypocrisy. By the way, it was obvious that Eric 2002 was fresh out of school even before he weakened his case by saying so. (2) Anyone who works at a bank and can't detect the incompetence and intransigence that is not only displayed, but actually flaunted, by many bank employees has one or more of the following problems: (a) Lack of intelligence, hence "moron;" (b) Inadequate experience with bank operations, perhaps because they are isolated in "executive" or "research" positions; (c) Denial, which is an emotional need to avoid facing the truth. (3) I hope that no one ever considers it necessary to apologize to these people. Of course, if anyone wants to humor them just to be nice, I can't complain about that either. Some of us have a higher tolerance for childish tantrums than others.

If your husband is on the loan, then YES they CAN take the funds from YOUR "joint" checking account very easily and very legally. Here's the kicker: If your husband has ANY accounts with his father (even if he is not in the loan), then they CAN take funds from ANY account your husband is in - including one where it's only him and you. If any of these scenarios applies here, I would call the bank and ask about "right to offset" or check your depositor's agreement - it's probably in there.

And I think you all have good points, I'll be working up the chain on this one. However, to those who were more serious-minded...GatorDeb, for example: My husband's name is not on the loan or on any other account with his father...however, what apparently happened was this: Father-in-law got this loan, and has 'Sr.' on it, but for whatever reason, in the bank's system, it mistakenly ended up with 'Jr.' on the name, BUT with 'Sr's' SSN. Weird, right? The REAL kicker, GatorDeb, is that in Missouri, I am not responsible for any of my husband's premarital debts, so even if it WERE his loan (his father previously called the bank to straighten this out but the bank didn't fix it), I STILL would not be responsible for this mess. Especially since I can prove to the bank that I'm the primary account holder here. At any rate, I'm glad my thread was so popular. It's the very first green arrow I've ever received. I'm so proud! And to the rest of you, c'mon. Many many bankers are morons. It's quite evident to me after this fiasco, and they've been not-at-all helpful. I'll have them over flames tomorrow. Thanks everyone for the great advice!! And if they don't get it fixed tomorrow by COB, I'll be calling an attorney (thanks George)!!

A common misconception is that there's a primary and secondary account holder on accounts - joint checking accounts give each acct owner 50% no matter whose name is first. You're not responsible for his debt, he is. If there's a tie between him and his father - a checking acct, a savings acct, etc - they can go after any acct he is in even if he's not on the loan. That includes an account in which it is only you and him. I will double check on this but those are my first impressions.

In fact, I was planning on a whirlwind of garage saling this weekend, and was gypped out of it because I was unable to pull out any cash. Boo!! So -- mistake or not, any other business would be liable for something like that. Gator...yeah, I understand what you're saying. A joint account is a joint account, I know all that -- but just not when it comes to premarital debts. At least, that's what I think. But I haven't actually been un-lazied enough to go check it out. har har!
