Help Need Question answered

    Have a capitol one charge off on report. i thought i was just Au but called them and they said i was primary. I said okay fax me a copy of the disclosure statement with my signiture on it, rep said they dont have one. if i send validation letter and they cant provide something with my signiture they have to remove from my report correct????

    Validation letters are typically for collection agencies. However, you could write up a letter to Cap One demanding for a copy of your signature on an application where you agreed to be the primary, or even co-singer(joint). Be sure to send it CRRR of course. Advise them they either need to produce a signature, or remove the account, because you never authorized them to open an account in your name. You should then dispute with the CRA(s). If they verify again, and do not provide validation, you may have to sue them. I'm not sure what this falls under (FCRA?) I'll have to look up some info, if I can find any. Or maybe someone else can provide some help.
