I had a truck with my ex-husband who took possession upon our divorce and he went into default. This of course affected my credit also with a repossession on my credit report. I never was contacted by the OC but a CA contacted me on Dec 2002 concerning this debt. I sent out a validation letter and never heard back from them. The SOL has passed on this debt it's from March 97 and have been deleted from two of my credit reports. Yesterday I received a letter from another CA Creditors Interchange out of Buffalo, NY I live in VA requesting payment on this debt. What should I do - Another Validation Letter? Should I mention the SOL has passed on this debt and good luck in collecting the $8,000.00 that I feel if anyone owes is my ex.
lots of SOL questions today.... Yea, I'd definitely send another validation demand, but also let them know that YOU know its out of SOL. this link has lots of good SOL info: http://community-2.webtv.net/YCHANGE/STORAGE/page13.html
Thanks for your response because I've got all the ugly marks off my credit and I don't need this sneaking back on it through a collection agency. I drafted the validation letter and will send it out certified mail. I made certain to mention that the SOL had expired on this debt. Thanks again!
