Thanks LK for the input. I used a variation of your letter to demand validation, and so far it seems to be working. Thanks again!
Sam is right, the ca can lose access to the credit bureaus if they delete a true account. I am dealing with one right now that absolutely will not delete an account, and that is their reason.
Did I do the right thing? IC System called me today at work demanding payment, however they have not validated yet...they sent me some B.S. "verification", but their time runs out on 3/7. I noted the exact date and time of the call and told the guy to put his terms in writing as I do not accept these calls at work. Can I slam them now or should I wait??? Please Help!
Re: Did I do the right thing? Andrew, you've got to level with your Creditnet pals in order for each of us to offer up our best strategies for how to deal with this. On 02.04.2002 at 08:36 a.m. you wrote: "I owe the money, so should I call the CA and ask for deletion upon payment?" On 02.18.2002 at 1:07 p.m. you wrote: "I won't pay 'em, 'cause I don't owe 'em." When lbrown59 mentioned the discrepancy, you again reiterated the idea that you never really and truly incurred the debt in the first place. Help us out. Which is it? Doc
Re: Did I do the right thing? To clarify, yes I did owe the debt, but it has since been paid to the original creditor. In my first statement, I should have made that clear. I don't owe the CA anything. It is my policy not to work with them.
they can delete an account and still be within their contract provisions if the account is in dispute. Meaning: say it's your account but the amount and dates are wrong Say the account is your husband/wife's but you'll pay it to get it paid but it's not yours Say they don't have validation but you'd pay if for deletion but you're sure it isn't yours (but it is) If there are issues with the validity of the account, they certainly can remove it. They do it all the time when they can't validate it.
Re: Did I do the right thing? Based on what you say here they have violated twice.1*Called before Val.2* Called at work. You could slam them now for 2 Violations or you could wait and see if they send the terms in a letter and if they do nail them again for a 3Rd. Violation.
Re: Did I do the right thing? Really? Three violations? I get the first one, calling before validating the claim, but I never told them not to call me at work, so would it make any difference whether they called me at work or at home? The second one, if they send a collection letter, will definately constitute a second violation. Did I mention that in their "verification" response to my validation letter, they demanded payment. That sounds like it would be a violation too, right? I like the thought of having them on three violations. I'm not after collecting $3K, I just want to make them go away peacefully.
Re: Did I do the right thing? 1*I could be wrong about the calling at work thing . read the FDCPA and check it out. Perhaps someone else will respond to this question! 2*Right that is a violation also. 3*They need to pay us some money. We're letting them off too easy. That's is why we have to keep making them go away.Maybe if we stung them harder in the pocket book more often they wouldn't feel so welcome to come around!
Re: Did I do the right thing? I dealt with IC Systems on a $50 collection last year. In my case, they reported a paid collection last year, 2 1/2 years after they claimed that I paid it. I never owed the debt in the first place and I sure never paid it. I had never even heard of the creditor. I fooled around with them by letter, phone and Fax before I found this board. Based on advice from Lizardking, I sent a validation letter CRRR. They never responded but they did delete from the two CRA's they had reported to. My impression is that it was not worth their time to reply and they did not want to waste any more time or money with me. They are nasty. I would rank them with NCO. Incidentally, even after I got a letter from the creditor saying they never dealt with me, IC refused to delete. It took the validation letter to get action. I think the validation letter may work. One warning though. If you called and got the special mailing address for validations, be aware that they do not pick up mail from that address. My first letter came back after 30 days and the PO said they never pick up mail from that address. If you made that mistake, send another one to their billng address.
Re: Did I do the right thing? Thanks for the info, but I send the validation letter to their billing address, which they accepted promptly.
