Help-OC 2nd request for info

    I have sent 2 letters to an oc asking for information because they have a charge off listed on my cr. My letters included the account number.I just received a letter asking for "a complete ID including full name, your social security number and your birthday."

    They tell me to dispute it with the cra if I believe it is an error, and the cra will provide them with the correct paperwork so they can verify, or not the info.

    They enclosed a copy of the letter they sent in December asking for the same info. (In response to my first letter).

    I have to get this off my report pronto.

    I have already disputed it with the cra several times.

    Do I send this:

    Dear OC,

    I have written to you twice requesting information about an account you have listed on my cr. I gave you the account number on my cr.

    Both times you told me to send you personal information in order for you to identify me.

    I do not intend to send you any personal information about myself. If you don't already have such information about me, why would I send it to you? I do not just send out my personal information to be added to files whenever it is requested. How are you claiming to have an account in my name if you don't know who I am?

    As far as disputing the account directly with the cra, I have already done so several times.

    Please respond in ten days with an answer. Either you know who I am, and you can provide me with account information to justify your listing on my credit report, or you need to remove the listing immediately.

    Here is the letter I just sent:



    September 12, 2002

    To Whom it May Concern:


    We asked for proof of an account that you are reporting to the credit bureaus. We gave you the account number. You have not responded with any documentation.

    We do not understand why you are reporting this to the credit bureaus in our names. If you had some information proving this was an account that belonged to one or both of us, we feel you would have provided it.

    We would appreciate your immediately removing this account from our credit bureau files.

    Please remove the listing from our credit bureau reports or provide documented proof that this account belongs to one or both of us within the next 15 days.

    Does anyone have any idea how to be more forceful or word things to make them respond to my request with something other than a request for more info? I don't have time for this silliness!!

    OtherTerri,

    I'd add a blurb at the end for some punch to get them thinking:

    Section 1681s-2(b) of the Fair Credit Reporting Act creates a cause of action for a consumer against a furnisher of erroneous credit information (Nelson v. Chase, 2002).

    or something similar, whatever you're comfy with that fits your style and tone but lets them know that you're not out of options.

    I just realized that the oc reported the debt again 9-2002.

    When I sent the first letter in 12-2001, same thing. Report stated "reported 12-2001."

    Just looked at report from 8-2002,and it still said 12-2001.

    Do I have them on violations?? The account was charged-off in '98. It was not a cc, but an installment loan.

    I believe so Terri, they should have changed the verified or status date, not the reported date.

    I understand that the scoring will now consider the newest date when computing your score.

    Now the computer is going to think it is NEW.

    Now it is more erroneous and damaging to you than it was before.

    Sorry, I keep editing, this makes me so mad, I swear they do this on purpose just to double dog dare you to do something about it!

    Oh good, I can still edit, LOL, are they reporting it as disputed? Even the OC's can't get around that and they've not provided you anything in the mean time.

    That is what I thought.

    Do you think I can file a lawsuit against them for:

    re-reporting the account each time I dispute

    not validating because each time I send a letter requesting val they ask me to send info to identify myself (and isn't this collection activity the re-reporting??)

    Thanks! I need to get this taken care of this week. Either I learn to file my first lawsuit, or I send a different letter than I posted above.

    Know what your problem is Terri? You're just way too much of a sweet heart.

    Just so you can see, here is a letter I faxed to a hospital after they entered 3 accts onto my CR's, all inappropriate. I GOT IMMEDIATE RESOLUTION ON ALL 3 ACCTS. Tell me if you think I sound powerless and unable to do anything about it:

    Have you requested the specific procedures for verification from the CRA's?

    And, I thought this was an OC issue, did I misread somewhere?

    ok, I re-read all the posts, it is an OC, they don't have to validate, but you can hold them responsible for their FCRA duties and responsiblities, and you've already notified them and the CRA so you can call their updated reporting willful and since they made it worse than it was the first time, you could call it malicious too.

    I didn't snip fave Butch dude's letter, but you could use that and just modify it at the bottom where he says the hospital is responsible for the actions of it's CA's.

    Well that's just it ... They don't take us seriously until we GROWL - LOUDLY!

    Why should they? They don't care until you get ready to get expensive, and not until then.

    It's not like it used to be. Quality service and all that ancient stuff.

    Today it's only about money.

    Whatever happened to customer service? Now it's about how far can we push before we get to the edge!

    I knew it was comin a long time ago.

    As soon as they figured out how to use technology, and expert marketing together, synergistically, the gig would be up.

    Now for every client they lose they gain 2 more. SO who cares whether or not you're happy.

    If I ran my business this way I'd be in jail.

    Thanks for your answers, Butch and Sassy.

    I did request the procedures from the cra last Dec. Just like all my other procedure requests, it was totally ignored.

    I have to get this settled. I can't keep playing this game of sending the same letter to me over and over asking for my personal information.

    What would you do to force them to do something???
