Hey all, Can somebody tell me what may be going on with my online dispute with Experian. I disputed 4 items 30 days ago, and 4 more items 15 days ago. Altho the status of the investigation shows some results for the first 4 requests, I havenot received an email or snail mail regarding the disputes. I called Experian and the woman told me that by requesting 4 additional disputes I reset the clock on the first 4. Does this make any sense? Even more bizarre is that the online investigation status page says that all 8 are due 30 days after the first 4 disputes. Thanks for your help! Tom
She is wrong. You did not reset the clock on the original 4. Call them back and ask what the second batch has to do with the first batch.
Is their failure to respond within 30 days a violation of FCRA? Also I asked her if the info would include the phone number of the "verifier." She said no - just an address of the creditor/collection agency. This seems to fly in the face of FRCA - "(iii) a notice that, if requested by the consumer, a description of the procedure used to determine the accuracy and completeness of the information shall be provided to the consumer by the agency, including the business name and address of any furnisher of information contacted in connection with such information and the telephone number of such furnisher, if reasonably available; Maybe I have to give them the 15 days from when I demand this info for them to actually be in violation?
I agree - I had 2 different disputes going on different times, when the first one came back in my favor then I went to CreditExpert - score reflected the change right away. Not sure about the e-mail though. I've always checked Experians site each day. If you have the report number you used then you can keep up to date with it...
Thanks df, I just figured out that I could recheck the experian site myself by beginning to request an investigation and then then stopping after seeing any info I wanted to see. One strnage thing that happened is that one disputed collection account seems to have fallen off, but the woman on the phone said it came back and that they refused to remove it. Anybody else see this kind of disconnect between what they say on the phone and what the report says online? Thanks, Tom
You said a collection item was deleted. Did you print out the page showing it was deleted with the date you printed it out? If you did, and they did not notify you within 5 days of re-inserting the account, that's a violation.
Thanks mindcrime, Yep - I have printed it out. Actually I haven't seen it reinserted yet - that was just based on the say so of the space cadet that gave me a whole bunch of other incorrect info. Thanks, Tom
