    LB - This is regards to a RMA, NCO was another situation - Inquiry. I did send NCO requesting info regarding the Inquiry.

    To recap the situation: I ordered my TU report. Listed was an account for CAP1, which is not mine. I requested validation from Cap1 on 2/15, CMRRR stamped/signed on 2/19 before I knew the process of disputing. Additionally, RMA was not listed on my report. I disputed with TU on 2/14, CMRRR stamped/signed on 2/22. After reading the boards on the process, I received a letter from RMA (regarding this alleged debt), so I sent a validation letter to RMA (Baltimore, MD address) on 2/27, CMRRR stamped/signed on 3/03. On 3/8, I received a settlement letter of 50% from RMA (with mini-miranda). Their letter was dated 3/4. I do not have the envelope in front of me to give the postmark date.

    After reviewing my report online yesterday, the Cap1 account is not listed in dispute. I will call TU today to verify that this is correct.

    What I need to know...how do I proceed? From my readings and understandings, RMA is in violation of the FDCP, section 809 Validation of Debts, (b). Am I correct on this?? And if so, what is the next step? Resend validation to RMA, enclosing a copy of my first letter with copy of greencard and stating that they are in violation of FDCP, and request immediate removal from my report. Am I on the right track or need to change trains?

    Oh....I guess I should not ask RMA for removal because they are not showing up on my report...at least NOT YET!!

    No, maybe not but they are trying to collect from you aren't they?
    In my mind it makes no difference whether they are on the credit report or not. They are trying to collect and that is more than reason enough to go after them before they do you some real dirt.

    In my mind, the fact of their having put a notation on the credit report is a secondary and relatively unimportant matter. What is important is the fact that from the very moment you receive a letter from a collector or a creditor either one you are in immediate and grave danger of getting sued and unless you want that to happen then you had best be prepared to deal with it in a manner that is effective and will put an end to the whole show no matter what happens.

    In my mind, if one does not look at it in exactly that way then the chances that it will happen are indeed great. I think there is more than evidence aplenty to support that line of reasoning.

    So to heck with the stupid credit report. I want to get my priorities straight and understand that if something is not done about the fact of the debt then one is doing little more than playing childish games in net effect.

    And while that may seem a harsh way to put it, if you stop and think about it, a child runs out in the street after his ball and fails to look both ways he is likely to get hit by an oncoming car.

    If one runs after his credit report he is likely to be in just about the same shape as the little child running after his ball and the car coming down the street is that motion for summary judgment.

    So I ask, just how far off is the comparison in reality? Not far I think.

    Thanks BB for your comment and email. I am in the process of making sure I know and understand my rights and the violations associated with this before I move forward, as well as what needs to happen next. I truly appreciate your comments.

    The account is listed as amount owed - $3193...settle for $1295.

    Update: I just spoke with TU - Cap1 nor RMA has listed my account as "in dispute". TU has the status of "under investigation" - no response from Cap1 (this was who I sent my first letter).
