Help please: Medical beyond SOL?

    Hi folks. New member here, half-way down the path to rebuild my credit. I've successfully challenged several entries from each of the CRA's and my FAKO scores have jumped about 100 points in the last two months!

    But, I still have a couple of flies in the ointment. I'm a 100% disabled veteran and the Veterans Administration (VA) provides the majority of my health care. But I had emergency surgery several years ago (February 99) in a non-VA facility, and the VA agreed to pay the bills. They did pay most of them, but there were two health care providers that failed to bill the VA properly. To make a long story a bit less tedious, those two turned their accounts over to a collection agency. I didn't receive a bill from either of the health care providers and, as far as I knew, they were paid. Neither did I ever hear from the collection agency. I discovered these two 'collections accounts' when I pulled my credit files.

    I'm in Georgia, the bills were incurred in Georgia and the collection agency is in Georgia. I'm trying to find out what the statute of limitations is on medical accounts, and I hope of you good folks can tell me.

    I know that the statue of limitations in Georgia is:
    1. Oral agreements = 4 years
    2. Open-ended accounts = 4 years
    3. Written contracts = 6 years
    4. Promissory note = 6 years

    The only thing I signed was the standard forms on admittance to the hospital. I presume that counts as some sort of contract but I'm not sure where it fits into the scheme of things as far as statute of limitations. I'm hopeful that this falls into the 'open-ended account' definition.

    For what it's worth, I've DVed the CA twice, CMRRR, and they have ignored the requests. They have made a couple of pulls on my credit but that's about it. I've never received any paperwork from them. The CA, by the way, is a local company and not one of the 'brand names'.

    I've also disputed with the CRA's three times each, but this CA has verified each time.

    It's now been 5 years since the bills were incurred, so maybe I'm out of the woods, maybe not.

    Thanks for the info. I sent them 2 validation letters per account, but they've ignored both of them. If I can be certain these are beyond the SOL, I'm going to tell this agency to kiss off.

    Does pulling your credit after a DV request count as continued collection activity?

    I checked out those sites but couldn't find anything specific to medical collections.

    I'm curious about that. I've run across a couple messages that indicated they do count as continued collection activity, but I can't put my hands on them right now.

    Update

    Well, there it was in my PO Box today: not one but two letters from the bottom-feeding collection agency DELETING the two collections from my credit reports!

    YES!!

    For what it's worth, I did send my ITS letter to the corporate address and to the home addresses of the corporate principals, and followed it up with a generous helping of e-mail to the CEO. Somewhere along the line they decided to throw in the towel.

    I don't know--I probably didn't do things by the book... but it DID work<g>
