i currently live in indiana. i moved here 8 years ago from iowa where i had used a atttorney to represent me in cival case. i never paid him completly and at one time in iowa he had placed judgment on me. when we moved here from iowa in 1997 and sold our house the realtor got him to sign off so his judgement would not come from house proceeds. now 8 years later my father has passed in iowa and when he seen legal notice in paper i find him once again placing judgemnt on me and my small inheritance. my question is is this legal or would statue of limitations protect me? thanks for listiong and please respond.
A domestic judgment in Iowa is 10 years and can be renewed in the 9th year. IOW, in Iowa, a judgment can be forever. It may be that while the attorney was willing to not go after your home proceeds, he renewed the judgment and has seen an opportunity for payment through your inheritance of your father's estate.
