Re: Re: Help..Used Hippa but have judgement the reason i said he/she paid the judgment is because they paid the OC who is also listed as the plaintiff on the judgment. when he/she began making the payments (i believe they talk about it in the original post) they didn't know the OC was the plaintiff and not a CA. so do you think the payments would be considered as being made towards the judgment?
Re: Re: Help..Used Hippa but have judgement Jenz, The payments were made directly to the hospital's billing department with no mention of the judgement. BTW, I may be one of the few people who was really not notified and didn't even know what the judgement was because in the credit report it does not reference the hospital. Upon receiving a copy of the judgement from the court (this year), I saw that it was for unpaid medical bills. I have never acknowledged the judgement with hospital and the hospital applied the payments to the original medical bills w/out interest or court fees.
Re: Re: Help..Used Hippa but have judgement Lbrown, 1. the $400 is more than the bills and doesn't inclued accrued interest 2. I paid on the bills not the judgement (never even acknowledged the existence of it) 3. Ohio revised code mentioned something about 5 years and I am still researching it

Re: Re: Re: Help..Used Hippa but have judgement Here is the problem, I have not mentioned the judgement at all in my dealings with the hospital. I have one additional bill that was never turned over to an outside collection agency BUT was included in the judgement. That is the final bill to pay and the difference between that bill and the judgement is $400 + interest. The recommendation per WhyChat is to pay the remaining bill and petition to have the outstanding judgement vacated. The judgement still shows the original balance but the ca accounts have all been removed.

But, if they accepted my previous payments as full compensation for those bills, it is highly unlikely that they can now come back and ask for fees on that bill. My biggest concern was how to approach the judgment as it is viewed separately from the collection accounts.

Please DO NOT confuse the legal issue of "satisfaction of a judgment" or "agreed on settlement offer" with the basic premise of the privacy issue of HIPAA. There s NO WAY that any added legal fees or interest can be considered to be part of a valid "medical collection", (unless we are talking about a finance contract for plastic surgery or orthodentures)
