Help please. I was served a subpeona two years ago from a local atty collection agency standing in for Arrow Financial, who was assignee to GE. I answered summons immediately and filed my answer and counterclaim. I then validated with atty who filed complaint but never heard anything from him after this. Kept checking with Court and case laid idle for 2 years. Received order from Court for status call on July 1 and went. The atty did as well. When we were called he requested time to speak with me, judge granted. He came over to me and asked me to call his office. I said fine, but I did not even know what the $876 (total $1,013 with court costs, etc) was for as he never validated (have copies and rrr slip to prove). He then told me it was for an old HSN account which I did in fact have. He filed suit during sol so I can't claim that; however, I know I did not owe them anything near $876. He again told me to call his office the following Weds. as he would be out of town over the 4th of July weekend. I called Weds, and Thurs and he was not back in office yet. I am going to call today but would like some assistance please. Do I have any grounds to negotiate this amount? Do I have anything in my favor in that he did not validate when asked? Any suggestions would be most appreciated. I DO have to call him if not today, at least by tomorrow as the way it was left with the court was that if we could not settle this, then there would be a pre-trial set for August. Help is needed fast, please!!!!
