I have paid collections/ chargeoffs which are becoming albatrosses around my neck. Here's the problem: Capitol One refuses to validate. The account was charged off 9/98 and paid in settlement 4/00. The date of last activity was 9/97. They refuse to respond to my validation letters and the reporting is inconsistent between the three bureaus. (Different DOLs, credit limits, Date of charge offs, etc.) I have sent certified letters, Planet Feedback'ed, even faxed. I spoke to Mr Cooke who refused to delete, but claimed he would correct the problems, but didn't. I finally used christi's Intent to Sue letter and I STILL haven't heard anything from these people!!!! I have saved everything and have copies of all of my correspondence and dates of converstaions with them. I am not sure what to do at this point, because they just wont write back!!! What can I do? Sue? Then I have three collections with NCO which are also paid and they refused to delete after they told me they would when I paid in the first place two years ago. I have also sent them validation letters and no response. I have disputed with the CRAs and they validate. They will not respond to my letters at all. HELP!!!!!!!!!
As far as NCO and not responding to your validation requests...if you have already sent your validation letter, estoppel letter, and finally an intent to sue, all of which they have ignored, you could send all your proof to the CRA's and asking them to delete (not to re-investigate), or you could go straight to court and sue NCO for multiple violations.
Thank you for replying... I have a feeling I will end up filing suit against NCO, the OC Progressive has no records on the account, they only keep them for two years, they told me this. I think this is why NCO is ignoring me! I cant believe I fell for the old trick of believing they would delete as they claimed but hey that was PRE creditnet! But Cap 1, am I right in presuming that I can do nothing more but continue to bug them? They are fully paid, after Charge Off. They refuse to do anything that even hints at deleting....!
