I filed CH 13 in 11/97. It was dismissed in 11/2001 because I fell behind in payments. On 7/2/03, I received a letter from a CA for Household Finance saying it has come to their attention that their previous letters may not have reached me due to an incorrect mailing address. The amount is $2622.53. DOLA is 7/96. Should I request validation or has the time to collect run? I live in Florida. I'm not sure if the four years in BK would have tolled the time and that leaves three years then. It was supposed to come off CR this month, right? But what about still being able to collect? Sorry for the lengthiness. Hope someone can help!! Thanks.
Florida SOLs: 4 years - Oral Agreements 5 years - Written Contracts 5 years - Promissory Notes 4 years - Open Accounts As far as tolling, all I could find was the fact that any payment, however small, tolls the 4 years. Don't know about bk...sorry.
