Help with a good validation LTR

    One CRA is reporting a medical collection with a DoFD as 7/06. Date Reported is 1/08. As far as I can recall, I have never been contacted by this CA. DoFD looks fishy BTW, as Date Assigned is 9/06...I feel that although not impossible, it is unlikely that OC turned over to CA that quickly; and then CA takes 16 months to report it to CRA?

    So I realize I can wait another 12 months and it should just fall off, however I rather go after them with asking for some validation first, but could use some pointers/suggestions of sections of the FCRA and FDCPA about how they (if this is even true) are required to notify me of the debt before reporting to CRA.

    The typical timeframe for medical debts to be turned over the collections is 60 days, as one website states:

    "Patients who do not pay their balance in full, who have defaulted on their payment plan or have not worked with our staff on payment arrangements will be considered delinquent after 60 days.     This is likely an industry standard.

    As far as the CA taking 16 months to report, the date you are referencing may be the date last reported, instead of the date first reported. Medical debt CA's usually do not update very often once they have stuck their tradeline on your report unless you dispute it, then the date will be more current.

    Thanks nunna -- but this was a small private practice. It was the doc and his daughter as the nurse/receptionist. No industry standard anything when it came to them. Just really surprises me that allegedly two months after last payment account gets send to a CA.

    Never disputed account -- till now. So if that date was 'updated' then in '08, was done for another reason. Either way I asked for validation, especially since googling the OC's office yields a dead number and he was ready to retire way back when, as I recall.

    Well if it was small practice, they may be more pressed for cashflow to keep the business going.
