Hello all, Here's my situation. I have two CC accounts that I am trying to get off my CRA reports. Both CCs have been sent validation letters, and one has given my, alleged, account to a CA. None have responded to validation. I have arbitration awards for both CCs, but I can't get them confirmed - CPLR for service by mail in NY dictates that defendant MUST reply - if they do not, then the Court issues another means of process service - until service is perfected. I can't even get an index number until service is perfected. Is it enough to have just an award? It sounds like I don't even need an award - just an angry letter or two. Any advice?
Help with arbitration - update Here's some more info. On Friday I requested these items be removed from all three CRAs. I'm not too enthusiastic, but I figure it's a start. The CA for Amex is no where to be found on any of the CRAs - BoA has just listed me as 120 days late. Amex has reported the account closed by consumer on two reports and closed by grantor on one - the balance remains, but there are no late payment reports. Amex has sent the acct to a CA, and I received letters from the CA and a law firm - I have asked for validation from them both - and I haven't heard anything from them since. Here's another thing - I had someone try to jack a discover card I had two years ago, so I closed all of my cc accounts and had all of them issue me a new acct #. BoA has recently listed that old acct # as active, with a balance! I have also requested this be removed from the CRAs. Any violation there, that I can threaten them with? I'm waiting for the CRAs to respond to the recent inquiry - I'm guessing that they will NOT honor my request - so, I'm wondering what my next step should be? Do I send letters to the CCs to get them to remove the unvalidated accounts? Do I remind them of the arbitration awards - even though they aren't court confirmed? Also, a suggestion - maybe you could tell newbies, like me, about the online resources the CRAs offer in viewing the credit reports? I have an account with all three, individual CRAs - I'm guessing there is a better and more economical way to get all three reports and be able to contest items on reports.
