I am trying to clean up one more collection account before I can move forward on buying a home. I have an outstanding collection with a CA for an old dentist bill. I went through the validation process. The CA clearly can't support it is mine. I spoke with the OC and they have no proof. The CA is rather stubborn and I am in a rush to get this removed (ideally with in two-three weeks). The CA will agree to delete if I pay the debt ($160) but I am a little weary about paying and then the CA not deleting the item. Or I can continue through the dispute/letter process. Anyone with suggestions are insight are greatly appreciated.
I paid one collection account (for a dental bill too) in exchange for a deletion. I paid by credit card (they charged me more) so I could dispute the charge if they ended up not deleting. I got them to fax me their agreement to delete so I'd have something to send to the credit card company if I had to.
If you really have proof they can not provide Validation than if your closing is more than 30 days I would start an dispute and provide the green card showing no response or what ever you have then it should disappear. Otherwise, you really need the letter don't pay them without it. Maybe you can explain the neg out to the broker and buy more time??
If they really don't have proof and you get denied for a mortgage, then I would say you should have a pretty good case for a lawsuit. Especially after you build your paper trail.
