Help with CA

    Hello, I have a collection agency that I am really having problems with.

    Maurader Corporation on EXP report. States that I owe 1307 (really on 755 w/o interest). I disputed with the CRA and it came back verified. I then sent out two validation letters finally getting a reply from the second one stating the 755 due, not the 1307 listed on CR. I then sent a settlement letter asking them to sign it if they agreed to the settlement or if they didn't agree to make me an offer and send it in writing to me. I have not heard from this company since sending this letter on 8/11 CRR (they rcvd. it on 8/16. What should be my next move?

    The first validation letter was your standard letter requesting a copy of a signed application/contract within 30 days of receipt of the request. I rcvd no response from this request.

    The second validation letter was the 15 day notice stating that if no response was received from them on this request they were admitting that this entry on my CR was not valid and should be removed by the CRA at once.

    You are correct, I did misspell the name of the company. So, as you stated above my next move should be the ITS letter? I know that they have several sample ITS letters posted on this board but would either on of you know exactly which one I should send that most pertains to my situation since I have already sent them a settlement letter? I only sent the settlement letter because DH and I are trying to buy a house by the end of 2003. We had a Loan Officer look at our CR's and that is one of the collections that has to be taken care of before anyone will offer us a loan that is not Sub-prime.

    I may seem stupid for asking but, How can I send an ITS letter when they have already properly validated and I have sent out a settlement letter?

    Ok, here is the ITS letter that I intend to send. Pls edit :

    In Re: Case # 465878

    Bill Palmer - Manager:

    On July 19,2003 I received a letter (copy is attached) signed by you stating that I should contact your agent Steven Parker in order to make immediate payment arrangements because you supplied me with the proper validation. On August 11, 2003 I mailed a letter to the attention of Mr. Steven Parker stating the terms that I thought were sufficient enough to settle this debt. I have confirmation that this letter was received by your company on August 16, 2003 at 1.22pm. To date I have not heard from Mr. Parker or yourself.

    I stated in the settlement letter that if you do agree with the terms that were listed to please sign, date, and return a copy of the letter to me and the first payment would be received by your company on September 25, 2003. I also stated that if the terms listed were not acceptable to please send me a letter stating the terms that you could accept.

    Since neither Mr. Parker or yourself have done the above mentioned I see it as if you are admitting that this debt is not valid and I do not owe your company any money. I will give you another chance to respond to the settlement letter (copy attached) that I originally sent on August 11, 2003. If I do not hear from Mr. Parker or yourself within 15 days of you receiving this letter I will take your silence as an admission that this debt is not valid and will pursue all of my legal options to sue you for all of the violations that you have committed under the FCRA.

    1*This is why you don't send a settlement letter with a validation letter.
    Also you don't send a settlement letter before they have validated
    2*Did the validation include the signed contract and a complete account history? If not they haven't validated.

    As far as the settlement offer It's been over 30 days since you sent it and they haven't accepted it so I would say the letter you sent is null and void and no longer binding on you; Therefore you can take other measures to resolve this matter such as an its.

    I would not send this.
    Instead I would sue them for the violations you say you have them on.
    Just one $1000 violiation will more then pay the 755 bucks.
    Me I would make them eat the debt.

    I sent the following letters in the order they are presented below:

    1st validation - no response
    2nd validation - responded with signed contract & acct. history

    That is why I sent the settlement letter because they did respond with the proper validation. That is why I asked the question of what can I sue them for besides not answering back on my settlement letter? I have not seen a posting for suing a CA that didn't answer back a settlement letter. Is their a law for such a thing?
