Help with disputes please...

    I need some advice:

    I have 16 separate entries (only $50-60 each) from one CA that are hitting my Eqfx report hard. Only 1 is near the SOL.

    Someone suggested that instead of disputing the accounts with Equifax, it would be quicker to start at the root of the problem and send validation letters.

    So my question is: Should I attempt to validate 1 by 1 or ALL together? 16 letters? or just 1 with all accounts?

    I would send all in one letter. Send it certified mail, return receipt requested. About 7 - 10 days after you send it, dispute the entries with the cra's. The reason for this is that once you request validation, they must cease collection activity. Reporting to the cra's is considered collection activity.

    OK...I sent the validation letter. BUT I sent it via fax to the CA. I have the printed fax receipt showing that they received my request for validation. Then, 7 days later, I disputed with the EQ & EFX. Today, I pulled up Credit Expert dispute section and I shows, "Remains" under ALL disputes.

    Questions:
    Am I screwed because I did not send my validation request via certified mail?
    If faxing is valid, is this not a violation?
    If so, which one and what is the next step?

    You need to send it via CRRR.

    So should I resend it via CRRR? What I was thinking of doing was sending a copy of the original fax, the original fax confirmation, and estoppel letter via CRRR.

    What do you think?

    Resend it via CRRR. I'm not sure how well a fax would hold up in court.

    What I would do is send an estoppel or demand letter certified r/r/r and enclose a copy of the original validation with it. Advise them they are in violation of the FDCPA for continued collection activity prior to completing a validation request. They are also in violation of the FCRA for failure to note the accts as in dispute. And, the next time you ask for advice, do yourself a favor and follow the advice given.

    Honestly, I should have taken the "CRRR advice" upfront, because, while not the most expedient way (time to go to post office, wait for green card, etc...) it probably makes the most impact with the CA's. I guess I was relying on advice from faircreditmovement which states that faxes are OK...

    I'll let you know what happens after I send the CRRR.

    Yes, you may have another. LOL Anyway, every dispute or validation i ever sent, was done certified and I never had one deny receiving it. I don't know if it came down to it, how a judge would rule on it if they denied receiving it.
