The following is a letter that I want to send to Arrow: April 18, 2002 Arrow Financial Re: Acct # To Whom It May Concern: In recently reviewing my credit report it has come to my attention that you are reporting false information to the Credit Bureaus about me in reference to the above mentioned account. The full balance of the debt that was owed was paid in full to the original creditor in 1996. This is not a refusal to pay, but a notice that your claim is disputed. I have never received any correspondence in writing or by telephone from your company as to the collection of this debt. Under the Fair Debt Collections Practices Act (FDCPA), I have the right to request validation of the debt you say I owe you. I am requesting proof that I am indeed the party you are asking to pay this debt, and there is some contractual obligation which is binding on me to pay this debt. Below are a few questions to answer which may help you to resolve these mistakes. You should also be aware that reporting such invalidated information to major credit bureaus might constitute defamation of character, as the negative marks on my credit report harm my credit and prevent me from enjoying all the benefits of good credit. I'm sure your legal staff will agree that non-compliance with this request could put your company in serious legal trouble with the FTC and other state or federal agencies. (i am new at this so I am not sure) I have honestly never had any communication with these people!!! I paid the debt in full to the original creditor in 1996. They claim that this was put into collection in oct 2001!!! The sol in NJ is 6 years but when does it start?? Any help would be appreciated!!
Sry I missed you in chat. I read here that on your first letter don't include your rights under the FCRA. It makes you sound like you are using a form letter or credit repair co. and your letter will get thrown in the "irrev" box? hmm> I'm a newbie, maybe a credit pro will help us both out. The letter sounds good to me. I first thought you were writing to the beureau. Actually I'm going to save a copy to use if you dont mind You sound like you know your rights and have discussed it with an attorney. I seriously doubt they will be able to provide the information you are demanding. I'm composing my first series of letters to the CRA's. This is day one for me. Good luck. .......boo
Here's my suggestion. You start off by admitting the debt was yours, but you say the debt was paid in 1996. What if they check this out and change it to a "paid Collection"? You would have shot yourself in the foot by admitting you originally owed the money. I would leave out that part. Ask for the standard validation. I am guessing it is too old and they will not have the records to validate.
Hey Guys. Just go to the Sample Letters and send the Validation letter. Someone has already painstakingly put these awesome letters together for us to use, they already have a proven track record and they say everything that needs to be said and nothing more. Good luck. Don't forget to send it Certified with Return Receipt. I always fax mine first, just so I can get it to them quicker and then mail it.
