i recently posted a topic about cap1 and almost being sued, so i had to start making payments to the ca (actual law firm). It didn't start over the SOL, because in GA you and the collector or oc have to have in writing the new terms of agreement. With that being said...here is my question. I am making payments to a law firm as stated....since august of last year. I have never received any receipts showing i have paid. I haven't got most of my receipts...wish i had (now that i found this board). So i want to know what letter can i send, if any, requesting a statement of all monies that were paid by me to the law firm? Also, i never signed any paperwork starting the SOL over (not that i can remember). So can i request to have sent to me anything that i have signed?

My other question is that on my credit report (equifax) i have two files that cap 1 listed as charged off with two different amounts. When i requested my address to be removed and received my new credit report......i still had both accounts still listed, but one was listed as FCNB and with the account number listed different except for the last four or five digits. What can i do about that? Right now i have a dispute going on with EQ regarding a collection account. ANY suggestions on both scenarios?

    For the first issue...

How have you been paying the law firm? Hopefully by check..then you have access to the processed checks as a form of proof. Also, I'd at least call them and ask for a statement...if it's a true "Law Firm", they shouldn't have problems w/ this...(always the optimist)

    For the second issue...

Not sure what happened here. You state that your EQ had 2 Cap1 entries. Were there 2 diff. chargeoffs or is this a blatent error? The fact that one of them changed after an address change makes it stranger.

Now, I assume Cap1 has sold whatever account(s) to this "Law Firm"..aka CA. If this is the case, i'd send a CRA dispute for both the Cap1 and FCNB accounts.

    Just my $.02

yeah...this is an actual law firm. i guess that i am scared because i don't want to be sued....i know that doesn't make sense if i am making the payments. MY SOL will end next year....so i don't want to step too far out right now.

also with the two cap 1 accounts on my records. like i said before both read cap1 when i got my first report from equifax and both had different limits. I only had ONE cap 1 card which carried a balance of about $500. So when i had my addresses removed and was sent a new report by eq, one of the accounts had the different numbers except the last four. AND it was listed as FCNB and a different amount. BOth accounts had different DOLA than my first report....so i don't know.

Are you sure it's a law firm. Many diguise themselves as such, and are not. Go to www.BUDHIBBS.com and read what he has found out about supposed Law Firms that collect funds on accounts.......
