    Today my mother was served from cityiback cc. she has not been able to pay then and just can't. her date of court is in march. She will have to fill BK has no assests. she has other cc can she charge them up then file BK? Califorinia is the state. I'm on the card as a user on the card as well but she is primery I'm just a user I filed bk back in 2001

    so do you want to know if she should willingfully charge money that she knows she wont payback so she can burn her creditors? it should look bad on you too since you are an au. or is she filing bk that she will be making payment arrangements.

    if her court date is already set then the only thing she can do is pay them before the date or make a payment plan with the oc.

    her intent was to pay, but with the death of my father she does not have the income anymore.

    In many cases, anything she charges within six months of filing BK will be HEAVILY looked at and she may have to pay back regardless and/or her BK will be thrown out and she may be charged in this Fraud.

    Any cash advances, large purchases, etc. will more than likely have to be repaid if they don't try to charge her with fraud.

    Talk to a lawyer.
