Hope this works. Here are a couple of links to the FCRA and FDCPA texts so people can take a few minutes to read through them and understand which regulations apply to what part of the collection industry (OC, CA or CRA) FCRA http://www.ftc.gov/os/statutes/fcra.htm FDCPA http://www.ftc.gov/os/statutes/fdcpa/fdcpact.htm And for those of you in California... There are few regulations for those of you affected by identity theft. Specifically, there are regulations on the books that prohibit the CRA from reporting any information alleged to have occured from an act of identity theft. You must provide them with a police report (from a California jusrisdiction) and a letter stating your status as an identity theft victim. After they receive the police report, they are required to promptly and PERMANANTLY block any reporting of that information alleged to have occured from the identity theft. The CRAs can get the information back on your report, but they have to satisfy large evidentiary requirements in order to do so. Hope that helps people out there.
I just noticed today that the version in the link you posted is not current. You should go to the FTC's FCRA 'portal' instead. The newest version of the FCRA I am aware of on the FTC site is a pdf file. There may be even newer text in the US code, which can be found at the US Printing Office or on the Cornell US code site. You'll need to look under 15 U.S.C. § 1681.
