HHLD BANK/BEST BUY Acct Removed

    Today HHLD BANK/BEST BUY Acct Removed. After validation letter which made them this accounts rating changed from collection to legally paid less than actual amount/Charge off, I wrote a Goodwill letter to the President of HHLD notarized and green carded. Today the account was removed from experian. I'll check the other CR's if this got removed from all.
    Please guide me on the following account.

    I leased a car from TOYOTA MOTOR CREDIT CORP in 1996 for 2 years and returned it in 1998. Was paid all. After returning the car they said I owe them money on the mileage which I drove over the limit. My old CR shows this account fully paid. SOL in California is 4 years. How do I start? Please advise.

    The Vehicle Leasing Act (CA Civil Code 2985.7-2992) would appear to be your best bet, but the provisions outlining termination fees and computation is limited to leases entered into on or after January 1, 1998. Since the SOL has run, you have two options, although there may be a few more creative ones:

    Looking at your delinquincy history, this account will fall off in July of 2004 (even though it says January of 2005, that is incorrect). If you don't need credit, you could wait the 16 months.

    OR

    Offer Toyota a settlement in which you pay them a small sum and they delete the account in its entirety. Be sure to get anything in writing BEFORE sending them a dime. Among the things to get in writing:

    You do not admit the debt is yours
    Toyota agrees to cancel any and all debt
    Toyota agrees not to sell any balance to any third party
    Toyota agrees to cease all collection activity
    Toyota agrees to delete any and all information reported to any third party about you or this account.
