hiding need CCC

    can you help me out with some civil codes Im trying to help some friends who have alot of problems

    I need anything you have on accord & satisfaction and what CA can charge as far as bank fees and other fees plus interest.

    I think the interest rate in ca is 10% a year are CA entitled to this as well IF there is no agreement such as collection of a returned ck ?

    I know off the top of my head in Ca the consumer is liable for "up to treble" the amount of the bad check..

    Ill have to look it up for more info though...

    Here is the bad check laws in CA...it is in the same site that Butch posted....


    In the "info" are links to the CA Civil codes...hope it helps..

    It is my understanding that collection agencies cannot ADD anything that was not allowed originally. So if they decided ON THEIR OWN to add fees etc, I dont think it is legal....but not 100% sure. :)

    " 58. Civil Code � 1719(i). If the claim is transferred or assigned to a debt collection agency, the collection agency must file in superior, municipal or justice court. The debt collector must give the payee the amount of the penalty recovered in excess of the debt collector's flat charge. (Civil Code � 1719(f).)"
