    hi was able to look up some CCC and was wondering if you ever used these

    landlord/tenant law re: sec dep refund 1950.5 punitive damages


    and this code I was thinking of trying this in small claims case but looks like its settled anyhow it was about venue and federal court vs state court 1788.17

    something about a state court can enforce fed law does that sound right?

    Under the FDCPA/FCRA state courts can enforce federal law.

    1788.17 states a debt collector in CA has to comply with the FDCPA

    I really dont know about other federal laws though.

    I ve never had a landlord/tenant issue thankfully :)

    the landlord tenant issue was I moved w/o giving a 30day notice, shame on me. circumstances prevented me at the time I was getting a job transfer anyhow

    the landlord is attempting to charge me 1/2 months rent for no notice which i think is fair or reasonable considering they can charge an entire month however I do not think they should be allowed to charge me a late fee of 10% as this was being taking out of my security deposit.

    next they never gave me the balance left from the deposit so I want to sue for that Im trying to find the SOL for that do you know off hand?

    Ive written over the past 3 months and they have me on ignore so I guess suit is the only way to get my money back its about 700$ after they deducted the 1/2 months rent

    its been a while...but I recall the landlord has 15 days to return the security deposit..Ill look for it...

    thx but i had this info already

    I meant how long does a consumer have to bring a court action after the fact to sue the landlord.

    are all the courts the same in ca ? is this a state law ?

    yup. whole state :)

    General civil cases the SOL is one year, unless there is a law extending it. In this case, I dont know :)

    One year is safe bet though.
