Hello! No frustration here, just simply not understanding. Smile. Cap 1 had a disagreement with me... over 7 yrs ago. I paid my fair portion to them. They sent it to a collection agency. With the first payment on a check of $100 they took the check and turned it into an authorized debit for $400. Then after disputing the claim, they sell it again to another credit collection and now are trying to re-claim it. Since this happened I do not give anything to anyone that says they are collecting for anything... NO CHECKS WHICH CAN be used to Debit from an account. Ya know that automated debit processing thing. I informed my bank, closed the account and began another account at another bank. Since this began I have taken care of all debts; except the good ole Student loans... no payoff yet, but in good standing, and have developed my credit history to a good standing; only because I care, not that I want a major purchase. Ok, so can I tell these people to go take a hike? Name has changed since then too, cause divorce. This was good because he was living with another woman. Smile. Hootie! Taking too much of your time, but truly interested. Who the heck are these crazy, bloodsucking, skin curdling, beasts anyway? I mean those dang on credit collectors. Too much stress I guess on their part. I am forgiving thank the Lord, but they sure aren't. Smile. Oh, forgot... it is still on my credit history cause they reopened it and it doesn't look like 7 yrs has past. {posted in the test area and someone gave me a hint: post it in the open thread. Ahh, now that's an idea}
I don't know how to quote in sections, so I'll do me best And, I hope the experts will weigh in too...... Um, looks like you were STOLEN from, cause you wrote them a check for 100, then they took it upon themselves to automatically debit 400? How fast can you say "SUE THEIR...BUTTOCKS!" How dare they make it to where you had to INCONVENIENCE yourself (ie, more damages), and open another acount to keep their grungy hands from taking more! They reopened it? Geesh darlin (in my Southern & Italian accent) - RUN to an attorney that specializes in stuff like this, cause if I were you, I'd be campin at his door...haha Good luck! Oh, and ain't no such thing as a dumb question
"With the first payment on a check of $100 they took the check and turned it into an authorized debit for $400." Did they send in the check, and did you get it back? Or did they just keep it, and use the account information to make up a fraudulent $400 debit? Did your bank reverse the debit, and did you put a stop payment on the check? Did you file a police report? There are people in this world who believe the law does not apply to them. Because of the cost of suing or prosecution, they can often get away with a lot, as long as it is only a little bit from a lot of different people in many states, and especially when they are in another state.
