Well, here I was...down to 2 derogs. Pull wk today and POW...I'm up to 8. 5 items reinserted, including that stupid acct that says I filed bk in 2000, a 94 bk, 2 charge offs. and a collection that shows up twice with diff acct numbers. I am sooooo pissed. I called on Monday and the rep says that the bk acct was deleted. Called today to find out WTF and they say I was told wrong. All she could do was re-dispute. Called back later and was told it indeed SHOULD have been deleted, but now she couldnt take it off because it was marked as disputed....along with the other 7 things on my friggin report. I am so gd mad! I was told by tu that when the items were deleted, it was per instruction of the creditors, not just because they didnt respond. So, now I have to wait another 30 days to see what they decide to do. Also, rep said "items were not re-inserted...the creditors re-reported. Is there a difference? You would think if they reinserted, yes, I would have to get notice within 5 days. BUT if the creditors re-reported, their cloaking deal should have kept it from my report. No notification, no nothing. Also, she had no clue about the cloaking thingy they are supposed to have in place to prevent creditors from re-reporting wrong info in their udf files. Thought of faxing them the part of the fcra where it says they must take reasonable measures to be sure the info doesnt reappear. WTF!!! Okay, need some advice on next step.
I just went through this EXACT thing with EQ. They told me the exact thing they told you. If it has been 5 business days since the re-insertment(thats what it is) they have committed a violations of the FRCA. It took me 45 min on the phone with them to get them to understand this. Get a copy of the FRCA in front of you when you call them. Read section 611 and understand it. If the items were deleted then when the re-appear that is called re-insertment. It doesn't matter if it was 1 day or 5 years. I got the item removed from my report and coded so that it will NEVER re-appear. Don't take no for an answer. Keep asking to talk to a supervisor if the person is unhelpful. I just saw something re-appear on my TU report also. I am waiting 5 business days then going to raise hell.

Shouldn't take long to build up a pretty conclusive history so we can see what kind of luck people are having with their disputing with the credit bureaus. The pros and cons of credit repair. Four20Nik: Sue. Sue. And Sue Again. Or at least threaten to do so! Reinsertion without notification is a slam dunk violation of the FCRA, and possibly other state laws depending upon your residence. Mr. Bauer: Aside from the fact that you posted something completely unrelated to four20niks plea for advice, I also think its a bit shady that you, who runs a competing credit repair service, is conducting a poll which purports to show that DIY credit repair doesn't work. -HDAlex
I don't run any credit repair service at all. I've never fixed anybody's credit and I never will. Please don't falsely accuse me of doing that which I do not do. Wrong again. I am not conducting a poll at all. I am merely giving each position, pro & con a fair and equal chance. Over time we shall see what those who post messages about their success or failure with credit repair have to say. More posts by people who have had success will show that it is still a working proposition or more posts by those for whom it didn't work will show that it don't work so hot any more. Same with the second set of autoresponders. I don't pick only people's messages who have had bad experiences with either Junum(ClearCredit) or Lex(Lexington) but rather I also put in messages from those who have been happy with their services. That gives others a good idea which of the two firms they want to choose if indeed they choose to go that route. I don't put in any comments of my own whatever nor try to influence the outcomes by unfairly excluding the good comments about either company. It will be the same with the new ones. I will not add any comments of my own whatever. It isn't about what I think. It's only about the results people have had. It isn't a sales tool at all. So quit trying to bad mouth me for trying to bring useful information to those who might happen to want it.
Yes, of course its possible. But let's be fair. I just put the two autoresponders up today and I'm not going back through history to see how many old posts I can dig up. It just so happens I've got one post for the pro side so far and two for the con side of the argument. We won't know the truth of the matter for maybe a couple of months or so. At least it isn't likely that we will. The only way to tell is over time and maybe at least say 50 posts on the subject. We can't jump to conclusions so fast. That simply would not be fair.
Oh! Ok! Its like this. I've never had even one little bit of luck with credit repair back when I was trying to fix my own credit. That was about 3 or 4 years ago now. I had a bunch of derogs just like a lot of other folks and before the big boys bought out all the little local credit bureaus I could get results by using various arguments with the local credit bureau. Arguments like telling them that a collection agency could not possibly provide any report at all for the simple reason that all they had was heresay reports and not first hand knowledge. I could convince the bureau that such second hand evidence was simply not admissable nor acceptable and that it had to be first hand knowledge. When they got bought out by TU that argument didn't cut the mustard anymore. So I went to using the standard stuff in common use today and fell flat on my face. So I figured out better ways that did work and got rid of stuff like magic. Now then, there has to be a reason why it isn't working like it used to. Maybe several reasons. I want to see if I can figure out why and I don't want to have to keep on digging up old posts trying to see if I can figure something out that will work better. I figure by collecting all the posts for those who have success (the pros) and those who have had rotten luck (the cons) maybe I can see a pattern there that will lead to something newer and better. What the heck have I got to lose?

On top of all this, the updated report they sent me showing the deletion of 2 items indicates a split file...so they delete it off of one and left it on the other. The split file has my ex's last name, which I never took. SO>>>> Now what. Do I call them and have them merged? The split shows nothing on this report except a bunch of inqs and the wrong name. I just dont want the name out there in limbo, ya know? The file number on this file matches the others I've received that used to have the correct info. Looks like they moved all my data to a new file and left very little in the original file. Dont get it. Dont know wtf is going on. Hate this.
Sounds like a split caused by worth knowing bumpage. As to the question of having them merged, that is tough. They both probably have the same SS#. I guess you could pull it several times and see if the more complete file pulls every time.
Out of curiosity, I pulled wk using the info from the "wrong" file. Couldnt authenticate. Maybe they already merged them, but STILL!!! I bet the 5 day rule for notification doesnt include mail time. I am sure they will send me domething that shows a date within the proper time frame. Until then, I will wait and hold off on calling them for a little longer before I complain. Meanwhile, all 8 derogs are in dispute...AGAIN. So frustrating.

Last time I disputed it, one of the times they verified,they updated my personal CURRENT info with all this wrong stuff. I called to have it changed back and I think that may have caused the split...all of my inqs went away (apparently it was the "new file") and I noticed the date they show as "how long you've been in our system" was only 1 month (I have a 12 year old file). The WRONG file, with wrong info, had the correct age of my file. Whatever it is, hopefully this will get starightened out soon. I dont even know if I should contact them before the disp on these 8 things are done...dont want to confuse them and give them more reasons to get my file wrong.

Yeah, I know...but my other question is this: There is a sec of the fcra that says measures must be taken to insure the wrong info doesnt re-appear back on my file. I read this yesterday. Any thoughts on this part, Jlynn? I am hoping that since these were deleted once, they will be taken off again, but this is stupid, ya know? I thought TU had a cloaking thing that kept stuff from re-appearing once it was removed. They were not removed due to no-response...they were removed with permission from oc/ca.
