There are two CAs (Portfolio Recovery and Asset Acceptance) that are trying to collect on debts that are over 7 years old. How do I respond to them? I'm not receiving letters from either. I'm just getting phone calls 3-4 times daily.
Validation letters include limited cease and desist stating you will only do business through the mail, not on the phone Are you sure these debts are past SOL for collection in your state? Has any time tolled on the SOL?? Don't let on that you know the SOL for collecting these debts has passed
I'm in NYS. The SOL is 6 years which passed in 2003 and the 7th years passed in 2004. These agencies are trying to collect on debts that haven't had any activity since March 1997.

Re: Re: Re: How Can I Deal with Old Debts? Next time they call, talk to them but say you are recording the conversation. Then tell them that you do not conduct business over the telephone. Tell them that you are advising them under the FDCPA that you do not wish to be contacted by telephone, and if they do so again, you will take appropriate action. Say that they need to correspond with you by mail only. Ask them to give you the name & address of their "agent of service" if it is different from the address on their company letterhead. Tell them that you will look forward to receiving their correspondence

Portfolio Recovery Associates, LLC 120 Corporate Blvd Norfolk, VA 23502 They must have bought a bunch of out of sol debts, I am getting calls/letters from them too about a debt that is 10 years old.
Re: Re: Re: How Can I Deal with Old Debts? Thanks, Lynn!! Would anybody know of a possible website that may list all addresses for CAs? I am really truly starting to believe that the CRAs and CAs are "in bed together" because whereas the CRAs used to list the CA addresses on a CR now they don't!!
