How do I find out who is lying?

    Sorry if this long and a little off topic. I posted a thread here about how MBNA was reporting wrong on my Equifax report and that it may cause me my already approved mortgage loan to be denied at the last minute. Well I got Equifax to update it correctly. My mortgage lender said they would pull an updated report to verify that the account has been updated. I pulled an Equifax report via their website on the 19th. It shows it's updated. However, my mortgage lender says they pulled one on the 20th and it's NOT updated. They say it still shows the same. So I call Equifax again. (They are starting to get really annoyed with me!) Equifax tells me that your file has not been accesed since 07/14/04 except for the report I pulled myself. I told them how my mortgage lender said they pulled a report on the 20th. Equifax says, no they didn't. I think I believe them because there are no new inquiries showing on Privacyguard either.
    So now I am at a loss for what to do. Equifax says they can prove that no one pulled my report. Someone is lying here and it may cause me to be denied for a mortgage loan. What are my rights here? The mortgage company is making a loan decision without correct information! What do I do? Thanks!

    Maybe the mortgage company pulled a report from a different CRA??

    Mortgage companies generally pull all 3 reports.

    Order copies yourself online and see if they made inquiries at the time they claim. If none show then you know they are lying so confront them with your updated report and take it from there.

    I pulled Privacyguard and there are NO inquiries on any credit report.

    The error was on Equifax and they wanted it updated on Equifax so they could pull Equifax again and see the update.

    If they provided you a copy of the updated report show it to them...

    Chances are their system is designed to not make a second inquiry within xx days, and automatically brought up the old report when they asked for the new report.
