How Do I respond to this?

    I received a letter today from an attorney that says as follows:

    Dear, slstafford hubby

    Your letter dated 1/31/03 has been refererred to my office. We are puzzled by its contents. It states "thank you for your recent inquiry". We have not sent any communication to you for a couple of years.

    Also, you state "that sending unsubstantiated demands for payment ..." We have not made a demand for payment for a couple of years. Possibly you have us confused with someone else. Please check you records.

    Insofar as you are requesting a validation or verification, you do owe $82 consisting of return draft fees. I hope this information is helpful.



    What are they talking about? They continue to verify with the CRA so in my mind that constitutes a recent inquiry and a demand for payment if they continue to report. If this is their validation that he owes the money, they better brush up on their FDCPA. What do you think?

    LOL. While I think you are technically correct, I don't think most CAs see reporting as continued collection activity or a communication. I also believe most don't know about or at least understand validation. Heck Butch and others have even said the definition of what validation exactly is doesn't exist. Obviously your goal is to continue with validation in the hopes of racking up as many violations as possible. Good luck.

    Problem is do I send another validation to this attorney or the other place? I love the although you do us $82, Hello that is what I was asking you to prove in the first place. Oh the attorney said I do, I guess thats proof right? NOT!

    The standard for passing the bar must have been lowered, so let me see how much clearer I can make this...

    I went the other day with my husband to buy a car and the loan officer told us that I had an old debt on my credit report as far back as 1994 JCPenney. the loan officer said this will make my truck payments higher. but I had call the credit beaur and they told me to come up with something to get this off mt credit report and seen it to them, now I know that the statute of limitation in arkansas is 5 years on keeping old debts on your credit report. so can you give me some ideal on what to do anyone.

    First off I think you meant to write as above, Correct? If that is the case when did you last pay this or better yet when did you first make your late payment? Is this an active account if not refer to above questions? According to what I have looked up it is the same 7 years as most states. I think you are thinking of the SOL if this is the case you are incorrect in assuming it would 5 years because that is a written contract. Credit cards are open accounts and that is 3 years in Arkansas.

    That is why I asked the person when the last payment was. Just because they may have opened it in 1995 does not mean they did not use the account in latter years.

    Why is it still listed after 9 years Rite?

    No wrong. If the last activity on the account was in say 1999 then the person will still have it on their report for another 3 years. Just because an account is opened in 1995 doesn't mean anything it is the usage. How do you think you keep good credit? If you have a card for 20 years and pay on time all the time that gives you good credit and continues to be reported on your report. If you opened the account in jan of 1995 and got into a bind and couldn't pay for some reason in 1999 then that is when your LAD and that will stayu on your report for seven years. -K-.

    I agree but is this why it's still on the report or is it for some other reason.The question at this point is still why is it on there after 9 years?
