Trying to help my wife remove a few of paid collections. Thus far we've had two removed from TU & Experian, while all 3 remain with equifax... (apparently they didn't receive the first dispute) Unfortunately we got things backwards by disputing as "not mine" with the CRA's first. As mentioned, a couple were deleted while one each remained as verified on the TU and EX; however, they're both different collections. From this point we sent out validation letters to the 2 "verified" CA's. Received back weak info at that, no signature and such. Anyhow, waited the 30days and sent out the Estoppal letter. Just now got off the phone with one of the CA's. Asked for my wife, who isn't here. Wanted me to call her at work and have her call her. I said no. She then started asking me questions such as my wife's SS, did we live in such and such a place. At one point in the conversation I told her all communication should be via written correspondence. Went on to say that she had sent us the requested information already and how if we didn't receive it she couldn't very well continue to send it. Nor if this wasn't my wife's info she had she couldn't send it. She did have the correct b-day and SS# for my wife but I told her "close" on the b-day... (not sure why I did). Anyhow, this was my first conversation with a CA and was definitely caught off guard. At no time did we submit a phone # but we are listed. I did end the phone conversation by saying "I guess we'll see you in court" Her response, "I'd love to" So my question then becomes. How badly did I screw up? Not only this phone conversation, but how badly have I screwed up all together? This CA is in California.. does that make a difference? I thought I remember reading somewhere on here about lawsuits in california being either difficult or not possible at all. Most importantly however, what can we do next?????? Help!!! Thankx zero

That's right...never admit to knowing anything about a debt when talking to CA on the phone. About the only thing to say to them is that they should communicate to you in writing only.
D'oh!! I'm a moron. Is there anything I can do to improve/correct the situation? Like I said, at the outset I mentioned that all correspondence should be in writing, and she got long winded about how she had sent a letter on such and such a date and we should have received it and that if we hadn't she couldn't keep sending them to us. She never did mention what the debt/collection was for (at least not that I recall and I certainly didn't mention it), does that help at all? Does my screw up really hurt my wife that badly? After all it is on her account, ... can she really be accountable for my stupidity on the phone? My closely comment was increadibly stupid, and I realized it as soon as it came out of my mouth
ok, here is my thought process, and i'm sure there will be those who will tell me i'm wrong, but here it goes....these are his wife's collections; they can't legally discuss them with him because he isn't listed on the debt; because of that reason they can't hold anything he said against her since they shouldn't have discussed anything with him.... anyone out there know for certain the legal ramifications for this?
1) "She already sent the info." 2) "If this wasn't your wife's info, she couldn't send it." 3) Yet they called. Sounds like they sent nothing, and she is full of BS. They can keep "sending" info until you receive it. Just my 2 cents.

Re: Re: How do I respond?? So then what should be our next step? We've already sent the request for validation and waited 30days after they signed the "green card". The phone call has to be in response to the Estoppal letter they received last week. Got the green card back yesterday (after the phone call that is ) Should we just wait it out for another few weeks.... then forward a copy of the letters and green cards to the CRA?
Re: Re: How do I respond?? Just received a reply from the "other" CA. I sent them a request for validation in mid Sept, heard nothing back and sent them the estoppel letter end of Oct. Anyhow, today in the mail came the estoppel letter (the orginal we sent) returned, along with this note written at the bottom..... "We sent an itemized statement to you on 9-xx-03 showing a SS# & DOB. Did you not get this? We are showing acct. paid in full. Call us xxx-xxx-xxxx. What are you requesting? (senders name)" Now what??? thankx
