I want to know how I would go about suing a CA. It all started 3 months ago, I recieved a phone call and American Agencies is on the other line, they want to collect, I say I can't pay, then I found out the debt was past the SOL, of 4 yrs., so I wasn't so worried . The man called 3 times in a 2 week period and threatned to sue, the 3rd call he said he was signing the litigation papers as he spoke. Haven't heard anything since. Today he called with the same old story, except this time he says he has never seen the file before and this is the first time speaking to me, he also said he had current work info on me, I haven't worked in 6 years, he wouldn't say what he had, but during this phone call he said that we will be sued by American Agencies and the Public Utilities Commission. Can I sue this CA for the threats that they didn't go through with and how do I go about it. Thanks in advance.
Have you tried to validate the debt first? I'm not really the one to give CA advice, I'm still working on mine, but I would think you'd want to get a good paper trail of violations, not just from phone calls (unless you recorded them) I think you'd just have a case of he said/she said. Send out a validation letter, and put in it a mini cease and desist, stating that they need to contact you through mail only.
I haven't sent a validation letter. I will send one. All I really need is a paper trail for me, right? I live in Calif. so I can't record the phone call without the other party knowing and I'm sure he wouldn't say the things he says knowing that he is being recorded. I just want to be sure I don't have anything to worry about when I send the validation letter. The debt is from the beginning of 98, so the SOL has past .I just don't want to mess things up? I just want to stop this guy from calling every 3 months or so and threating to sue us.
