Are they one of those really nasty CA's who don't validate and continue to harrass you anyway? Does anyone have a address and fax #

    thanks,
    Candi

I've sent validation and estoppel. Got green card back on estoppel last week. Still no word.. been dealing with them since Dec 01. It's a paid co.

    Thanks Christi and Mindcrime2

Mine is a $40 charge. I'm hoping they will think it's not worth the trouble of validating. I paid the original creditor but it is not showing as a paid collection. I can't seem to find any address or fax for them though.

I dealt with IC about 5 years ago over a $60 co. I mised a Doctor appointment, they charged me, I never paid and they sent the debt to IC Systems. I have disputed as not mine 2 times with EQ and both times they said it was verified. I did both of these in the last 16 months and EQ refuses to investigate again. What can I do? Will a validation letter help at this point?

It's worth a try. When you write your validation letter start with this:
It has come to my attention through the credit reporting agencies that you claim I owe you a debt. I am very distressed that you have failed to follow the law and notify me of this alleged debt before placing it on my credit report.

Then just go on with the rest of the validation letter. I think you only have 30 days to dispute after they notify you of the debt so don't admit that you had been notified.
    Good luck,
    Candi

really? why do they always give you 30 days when they send a letter? Are they required by the FDCPA to put a notice on their first mailing stating that you have 30 days to dispute the validity of the debt?
    thanks lbrown

You can send a validation letter at any time. Some people are under the impression you only have 30 days from receipt of notice. Send a C and D a few days after you send a validation letter. I personally like to fax. It is same day, you have verification, but mainly the snail mail is getting slower and slower. That alone can add 10 days to your time limits. Charlie

Yes the FDCPA says you have 30 days after receiving the first notice to dispute the debt. Also you can add a C & D paragraph in your original validation letter, which is what I do. Then if you they get so caught up in the validation they ignore the C & D paragraph and start calling you have their ASS!! I have one right now on this, she was so worried about the validation she called 7 more times. I have filed a complaint with the Texas AG and have an attorney working on this.

Christie is right. BUT, how can they prove that you received the notice? Did they send the notice Certified? Of course not. Sometimes you have to play the games like they do. Charlie

You and Christie are both wrong .
Your right to demand Val. is not limited to 30 days.

    Candi,

I am currently in the process of bringing IC System down; they've already screwed up twice with out validating...I'm waiting for them to do it a third time. Anyway, you should like the ones that harass you after you send a validation because the more laws they break, the easier it'll be to make them go away.

You can dispute a debt and request validation at any time. But if you don't dispute within first 30 days of receiving their notice of the debt, then creditor can assume the debt is valid and put it on your credit report.

Spears v Brennan quoted here alot confirms that you can request validation at any time. If the CA really wanted to get technical you could ask for the supposed letter they sent you intially. Most if not all of the letters they send you are illegal dunning letters which are disqused as "Your right to validate" letter.

I spoke with a certain supervisor at IC Systems, a real bit*h on wheels. She gruffed at me ala Collectech, about a paid collection. This brainiac dared me to file suit. They have absoluteley no documentation and my pediatrician called herself and asked to have the entry removed, they refused. Can you believe these jerks? I have more problems with these little paid collections than anything. I had a 4 year old charge-off with AMEX that rolled over and deleted after the estoppel. The world is topsy-turvy. Got Citi today $2000 AA card in the mail...yeah baby. Sorry UnionDiva don't mean to gloat.
