I have 2 credit cards totalling under $10k. I've been unemployed for the past several years due to an illness and am also currently going through a divorce. Soon-to-be ex-husband had paid my bills up until 6 months ago. I wrote both collection agencies handling the credit card accounts explaining what I just wrote (unemployment & divorce), but I'm still getting bills & letters from them. Wondering how long it would take credit card companies/collection agencies to just charge-off the accounts. One last thing, ex-husband wasn't a joint account holder on either card---they can't go after him, can they? I would love any tips or advice on the matter.
You are right at the point where credit cards will charge off the account. As a point, only the CC company charges it off, collection agencies handle the account after it has been charged off. As for your husband's liability, technically he has none since he is not named on the account. However, generally all debts must be settles out of mutual assets before a divorce is finalized. If your husband has the funds, generally the court will make all bills be paid first. I would push this point in the divorce. You may want to make it part of the divorce settlement. Good Luck
