Let me get this right, the OC can list a derog entry on your CR. Then a CA can list a derog for the same debt. Then another CA trying to collect the same debt can make an entry. Then JDB can list negatives?? So you can really have 4 or 5 negatives on your credit report that all originated from one credit card? Rob
That is double jeopardy to the extreme. There may not be any laws directly addressing this, but its definitely ethically wrong. This is definitely poisoning your file.
My guess is that any one account could result in the following: a) a tradeline from the OC that shows it as being charged off b) a collection entry in the "derogatory" section showing it as being assigned to a collection agency c) if the 1st CA sells the debt to another CA, then #1 must remove their entry (as it is no longer in collections with them) so if that entry is still there, you should be able to dispute it with the CRA and get it removed. d) if the 2nd (3rd, 4th or whateve) CA sells the account again, then repeat the process in (c) so that only the current CA is listed. Now, if it goes to court and they get a judgement against you that could show up in the Public Records section as a Judgement in addition to the Collection account and the OC's Tradeline. So, my bet would be that in the worst case scenario you could have three derogatory entries for one account (OC, CA, and Judgement)
