How often does this happen?

    My husband went to court today Providian has filed suit against him for 2300.00 Court time was 1:30
    The attorney representing Providian didn't show up and the judge dismissed the case. I am still trying to see if it was with jurisdiction or without. Now what happens do you think they will file suit again later down the road? Don't they have to pay court costs for today for not showing up. I was on pins and needles all day long. I know it's not over but it was load off my mind that the first round was dismissed

    That's exactly why they dismissed it. No plaintiff, no jurisdiction. Lack of prosecution of the case. But that's not what you really wanted to say. What you meant to say wasWITHOUT PREJUDICE not Jurisdiction. Big difference. And no, the judge would not deny them the right to bring suit again just because their lawyer didn't show up. Maybe he died or was captured in that terrorist attack on the Ramada Inn.
    Yes, I do. I would count on it.
    They already paid that. So they forfeited and will have to pay again.
    Don't know why. Just a bit of a laugh is all. They will be back.

    How old was the Providian debt when they filed on you? I have a $3000 chargeoff about 6 months old. I'm wondering if that's big enough for them to want to sue over.
