In 1999 my wife got suckered into accepting one of those cards where your entire limit consists of fees. It was sold as a credit repair package though, complete with documents that were mailed after she signed up. Well, she realized what a sham it was by the time the materials arrived and sent them back everything, asking them to close the account. They refused and told her she would still have to pay reguardless. Aside from an occasional letter or phone call, we haven't heard from them much, but now that I am trying to help clean up her reports, we need to deal with the several CA's that have this account. I'm not entirely sure how we should tackle this. In essense it was a fraudulent tactic by the company that signed her up for the card. (At least I think you have a reasonable period of time to reconsider such a purchase, especially accross state lines.) Would it be enough to just dispute as NOT MINE with the CRA's, or should we also go the validation route with the CA's? I honestly feel this was guenuine fraud on the part of the original company (UNITED CREDIT NATIONAL BANK, if anyone is interested). Just curious how you creditnetters would go about fixing this, as it seems a bit different then the typical collection listings. Thanks in advance.
I would hit them all with Validation letters first. Wait until you know they have them (CRRR), then dispute. Clearly at most one CA could "own" the account and possibly have some documentation. So, at most, one could Validate to you as well as Verify to the CRA. Anything beyond that gives you someone to sue.
I would also check out your State District Attourney's web page for Scams under Consumer Protection. If the debt isn't too old they may be able to look up the company and see if they ever declared it to be a scam. There maybe outside support/relief there as well.
There seem to be a few listings under united credit national bank. what is the address this listed on their card or information.
Well, I doubt if my wife has any paperwork directly from them, as she is terrible about that! As listed on EXP though, the address is 220 E Denson Road, Sioux Falls, SD 57104. Hmmm, EFX has them at PO Box 1229, Sioux Falls, SD 57101-1229. It's odd to note that the listing from UCNB shows as a good account on EXP - Transfered, as of 7/2001, but they reported as charge-off 9/2000 on EFX...
Hmm you got a piece of Household bank. Definately start with the 30 day validation letter. I sent mine by fax and it worked just fine as proof. BBB Reliability Report Household Bank 2200 E. That makes sense now... Because we couldn't figure out why Household Bank was even on her reports, having never dealt directly with them. They show on both reports as OC for the same or similar amounts as UCNB. Now it adds up, what SCUM.
