My problem is I have several items that should shown as iibk with a zero balance. They are instead shoing as chargeoffs with balances,or open collections ect. After trying not mine,and coming back verified,I tried iibk and came back verified now they said they wont investigate anymore and I must send them copies of my dishcarged papers which I refuse. Now im stuck cause I now have these accounts looking like they are still collectible instead of being iibk. Same problem with tu and equifax.
Why do you refuse to send them your bankruptcy papers? If you already told them in writing that you acknowledge the bankruptcy, there is no reason to not send them the bankruptcy paperwork. You admitted to filing bankruptcy, the papers are public record, so what are you afraid of? Send them the papers and get the information corrected.

However, this is not his responsibility - the bankruptcy court has already sent the OC a copy of the discharge. Sending them a copy is probably the most expedient way to get it off his reports, but it irks me that OC's won't follow the law on this. They sure as hell know that he filed bankruptcy and that it was discharged.

Send letters to the oc's advising them they are in violation of the FCRA for reporting incorrect info and may also be in violation of federal bk laws. Tell them you demand they either correct the info they are reporting, or if they find that too difficult, then they need to remove the tradeline from your reports. Advise them that should they fail to do one or the other, complaints will be filed with the FTC, BBB, comptroller of the currency, your state atty general, their state atty general and as your atty has advised, you may file a lawsuit to protect your legal rights.

TransUnion already knows the guy filed bankruptcy, and the bankruptcy forms are public record. Please explain how it can hurt him to send TransUnion the bankruptcy forms?

Suppose the oc's didn't respond. They would then be deleted. 3 months later he sends in his bk docs per their request. Guess what? All the accts that were deleted are now back on. Does that hurt him? Yes, I think it does. So it has nothing to do with being paranoid. It has something to with caution and thinking ahead, which some haven't done. There are laws that protect consumers from this kind of nonsense. If they can't report the info 100% accurately, and have verifiable, then they can't report it. So, IMO, and many, many others, he should write the complaints and if that doesn't resolve it, he should sue them for violating his rights.
