Hi I have a medical acct not sure what it is. I tried to validate in May..they CA NEVER responded to me but marked the acct as "in disputes" I had EQ investigate.It came back as verfied (of course) so I complained to BBB. I got my response back from the company today saying "We recieved a request for validation of the above acct by a letter dated May 8 and fullfilled our obligation by sending an itemized statement May 17. At that time the status of the acct was changed to dispute. If after reviewing the information,the account was still in dispute we would have expected to hear form Mrs Sbdmom..." Now what ? Intent to sue with a copy of wollman letter showing even if they had sent it to me a signature should be included to validate? I have no strong violations here to I ? besided lack of validation that they say they already sent.. so it would be my word against theirs.. Help please give opinions on how to proceed if ya can Thanks Jamie
I would simply send an intent to sue and give them 10 days to cure or be sued. Sorry to say Jamie, you may need to file and get a case number on this one. But once that happens they'll probably be in touch, right smartly, to make you go away. That's how'd Id do it. Also be sure and study your Spears V. Brennan case. It has a lot to say about computerized statements. hth
