Sup All, Need your guidance on how to handle this. Husband applied for and got a credit card under wife's name 2 years ago. Wife never knew and husband charged it up with cash advances for gambling. Husband came home first and was always shredding the statements. He made minimum payments over the course of time, but, in September, wife noticed an additional card in her name pop up when she registered to check her accounts online with BofA (California). Until that time, she didn't trust online business. Husband denied he was involved, and they complained to BofA. BofA cancelled the card and husband stopped making payments. Now it seems that BofA and collection agency(we think) have started calling. The balance is about $9K. They want to pay this off now since the husband came around and confessed. However, before he confessed, the wife spoke with someone at BofA or CA that was very rude and told the wife that she should claim this is fraud and that she will have to testify against the husband since that is who they thought was behind this. She didn't believe them and was pretty shaken up. Husband confessed afterwards. Anyways, now they want to clear this up and pay this off. What is the best approach here? Can we get a deletion letter if they agree to pay the balance off in full? Or should they just pay monthly and on time now? Also, the husband's other card was just frozen due to "fraudelent" activity that they said was associated with the SS#. This is a totally different bank and different cc. How is that possible?? Help please. I am the brother of husband.
Just make the monthly payments if the account isn't charged-off. You won't get a pay for delete from bank of america.
Perphaps wife agreed with the CA to testify against the husband when they called.They can only freeze CC if someone logged a complain or are ready to testify.Did the husband call them up to find out? Did he have other CC's as well which are frozen?
