how to interpret..

    Hi ,
    I am going back and forth with this CA. THey have lumped two collections I have with them into one "acct". They have reasonabley validated one of the accts not the the other. The collections have been vefified with the CRA. I recieved one settlement offer from them saying their "client "(oc) will take 50%. I wrote a letter back saying talk deletion and we will be in business. no answer. I started CRA to verify the acct the that has not been validated I recieved a demand for full amount from the ca. Now today I got a new settlement offer for 50% again stating
    "Gess and assoc. and our client agree that this will represent final and complete payment of the accts.and Gess and assoc. and our client will agree to repair any outstanding marks of the below accounts from the credit bureau."

    Can I interpret this as they will delet if I pay?
    or is this a contrued way of saying it will me marked as paid. These CA aren't forthcoming with info and are real slow to reply. What a pain whew!

    Thanks for any thoughts I really would Like to get these off the CR..also I have already tried to go the the oc they didn't repond.

    They cannot lump two debts together to create one. Somehow, although I can't explain, that would violate this portion of the FDCPA:

    Ã? 810. Multiple debts
    If any consumer owes multiple debts and makes any single payment to any debt collector with respect to such debts, such debt collector may not apply such payment to any debt which is disputed by the consumer and, where applicable, shall apply such payment in accordance with the consumerâ??s directions.

    Well, I would take that section to mean that if you have one debt that is disputed and one that isn't, the CA cannot apply the money you pay to the nondisputed to the debt in dispute. This makes sense b/c you wouldn't pay a debt that you are disputing is yours.

    To answer the question about deletion, that language they gave you does not require them to delete the account from the CRAs. You need them to actually state that they will DELETE not "repair". Repair could simpy mean that they will change to Paid Collection or whatever.
