If I have a paid judgment, can I get that vacated? Do I need to contact the filing attorney or can I file the paperwork myself? If it is vacated, do I need to notify the CRA's to remove it? Anyone ever heard the term "bullseye" when speaking in terms of the CA having the judgment removed from a CR; they "bullseye" it?
Vacating a judgment is where youâ??re generally asking the court to render a decision that it should not have been granted usually lack of service etc... The creditor must mark the judgment as satisfied i.e. paid and notify the court. Bullseye is a term that Experian uses; it grants the creditor access to your trade line and generates a copy that they can make changes from. If the judgment shows up as public record info the CA may not be able to do anything with that but would preferably delete the collection account or mark as paid but deletion would be best and you should inform them that you paid on the premise that the account would be deleted. There are some possibilities if you can show that the judgment should not have been granted, service, clerical mistakes fraud etc... If it was a default judgment and youâ??re not outside the time the court allows to file to vacate, you could file the motion to vacate with your paid receipt the CA or OC will get a copy and as long as they donâ??t object the court should grant your motion to vacate the judgment. Some of the more experienced legal eagles may have some additional thoughts
I paid the judgment B4 I found this board, and of course I did not get it in writing...the CA said that upon payment they would "bullseye" the judgment from all three reports. That was about the 3rd wk of July...and it still remains on all 3. They sent me a letter stating that they were removing the "above referenced account", as they state in the letter on their letterhead. But it says nothing about the judgment, nor do any of my credit files say anything referencing that "above referenced account". Then I found this board!! I sent them a follow-up about 2 wks ago and their reply letter said that they "fill out a form and send ti to the CRA's" and no cpy is kept on hand (good save, eh?) THey go to advise that I should dispute the judgment with the CRA's, which I have done since I found this board in Sep. They always come back verified. I was f****d by this CA and I have no one to blame but myself, however that's over with now. I am just trying to get if off my reports. It does say satisfied though. Couls I approach this attorney that filed it to begin with and ask him to file to dismiss it? It's been paid. What would he have to lose>
If it's been satisfied I dont know if you have much recourse to get it vacated and you still would need the underlying reason that it should have not been granted in the first place.
In many states, you can't get a paid judgment vacated. I tried here in Florida, and they don't do it.
