Hows my letter? Dear Experian, I have been very patient with your companyâ??s lack of compliance in the Fair Credit Reporting Act. I am no longer going to idly sit by while you break the law at my expense yet again. On February 15th I requested the procedures that your company used in investigating accounts you were reporting erroneously on my credit. I allowed you the 15 days allowed by law to provide those results to me. It now has been almost two months since you received that letter. You still have not provided me the procedures of investigation- in fact your company has refused to investigate the items any further when I provided proof to you that the companies promised deletion. I ordered a credit report yesterday and not only did I see that you have not deleted the accounts as you are required by law to do if you cannot provide procedures but you also reaged and reinserted an account on my credit. As you know failure to properly investigate items submitted for review and the reaging and reinsertion of accounts are enforceable violations of the FCRA. I am prepared to file suit 3 days after the receipt of this letter by your agents. I have many documents proving the re-aging and reinsertion and copies of the certified mail requesting the procedures you failed to provide me as well as a letter from the company stating deletion would be made which you also received on the 15th. As I see it here legally I am entitled to $4000.00 for your violations. The money would be nice but I donâ??t really want to have to sue you for you to do your job! You have the ability to stop this lawsuit. Please immediately comply with the FCRA and delete these accounts.
Hows my letter? my personal opinion, lose the: The money would be nice but I donâ??t really want to have to sue you for you to do your job! it lessens the power of all your previous statements.
Hows my letter? you might also want to throw in that that FCRA REQUIRES the following from them in regards to their investigations: 1) use your evidence in their investigation 2) maintain fair and EQUATABLE procedures 3) excercise their responsibilities with fairness & impartiality.
